The federal government is delaying a new rule that could make it easier for millions of workers to unionize after business groups sued. The National Labor Relations Board says the rule, which was scheduled to go into effect next month, will now be effective Feb. 26 to give it time to resolve legal challenges. The U.S. Chamber of Commerce and other business groups sued the NLRB last week over the so-called “joint employer” rule. The rule could potentially require companies like McDonald's or Amazon to bargain with workers, even though those workers are employed by franchisees or independent contractors.

West Virginia Sen. Joe Manchin says if U.S. voters give former President Donald Trump another term in the White House, “he will destroy democracy in America.” The comments come amid speculation that the West Virginia Democrat is eyeing his own third-party run for the nation’s high office. He says he doesn't want to be a spoiler who contributes to electing someone else. Trump won every West Virginia county in two presidential elections. Manchin also had criticism for Democratic President Joe Biden, saying he has been pushed too far to the left during his term in office.

Quinn Slazinski and Kobe Johnson scored 19 points apiece to lead West Virginia to a 70-57 victory over Jacksonville State. He made 7 of 18 shots from the floor, including 4 of 11 from 3-point range.

Starting quarterback has been a position under fire in the Big 12. Whether due to injuries or coaching decisions, staying on the field has been a challenge for many of the league’s quarterbacks who started the season No. 1 for their programs. Injuries have knocked out starters at some point in the season Texas, Kansas, BYU, Baylor, Texas Tech, TCU and West Virginia. Oklahoma State’s quarterback carousel through the first few games had the Cowboys rotating three players before finally settling on Alan Bowman.

Jayden Harrison returned the opening kickoff 98 yards for a touchdown, Rasheen Ali had 163 yards rushing and ran for three second-half TDs and Marshall beat Georgia Southern 38-33 to snap a five-game losing streak. After a short punt gave Marshall possession at the its own 45, Ali ripped off a 55-yard scoring run that gave Marshall the lead for good with 10:51 to play. The teams traded punts before Georgia Southern failed to convert a fourth-and-3 from its own 9 and Ali scored from there to make it 38-26 with 2:41 left. Davis Brin was 29-of-54 passing for 307 yards with three touchdowns for Georgia Southern.

Dillon Gabriel accounted for a school-record eight touchdowns to help No. 17 Oklahoma roll past West Virginia 59-20. Gabriel passed for 423 yards and five touchdowns and ran for 50 yards and three scores. Drake Stoops had career highs of 164 yards and three touchdowns receiving, Gavin Sawchuk had a career-best 135 yards rushing and Nic Anderson added four catches for 119 yards for Oklahoma. Xander Rice scored 20 of his 30 points in the second half, Jack Collins had 17 points and a career-high 10 rebounds for his first double-double and Monmouth beat West Virginia 73-65. Collins made Monmouth’s final field goal with 2:58 remaining for a 68-55 lead. Rice missed a free throw with 58.1 seconds left but Collins grabbed an offensive rebound before being fouled. Collins missed two straight free throws, following an offensive rebound, and Seth Wilson made a deep 3-pointer to pull West Virginia within 69-65 with 43.4 left. Rice made two free throws for a 71-65 lead, and Wilson and Josiah Harris each missed a 3-pointer at the other end. Jakari Spence added seven points for Monmouth (1-1), which was coming off a season-opening 72-61 loss to George Mason.

An attorney says the state of West Virginia has agreed to pay $4 million to settle a class-action lawsuit filed by inmates over jail conditions. Plaintiffs attorney Stephen New disclosed the figure Thursday in federal court in Beckley. News outlets report a judge must approve the settlement. The money would be split among more than 9,000 inmates at the Southern Regional Jail in Beaver dating to September 2020.  The lawsuit was filed last year. The suit referenced a lack of access to water and food, as well as overcrowding and fights that were allowed to continue until someone was injured.

Democratic Sen. Joe Manchin of West Virginia says he won’t seek reelection in 2024, giving Republicans a prime opportunity to pick up a seat in the heavily GOP state. The 75-year-old Manchin revealed the news Thursday in a statement, saying he had made the decision “after months of deliberation and long conversations” with his family. Manchin's decision to retire severely hampers Democratic hopes of holding on to the coal-country seat. For the last few years, Manchin has been the only Democrat elected to statewide office in West Virginia, a longtime politician who has served as governor, secretary of state and state legislator.

Oklahoma and West Virginia are among five teams sitting a game behind Texas and Oklahoma State in the race for berths in the Big 12 Championship Game. Oklahoma was well positioned before close losses to Kansas and Oklahoma State put the Sooners on the verge of repeating last year’s late-season collapse. West Virginia can earn its seventh win in a season for the first time under fifth-year coach Neal Brown.

West Virginia has beaten Oklahoma only once since joining the Big 12 in 2012. That was last season. They meet again Saturday with the 17th-ranked Sooners coming off back-to-back losses that pretty much ended any hope of making the four-team College Football Playoff in their final Big 12 season before moving to the Southeastern Conference. West Virginia has won two in a row and is already bowl eligible after being picked in the preseason to finish last in the 14-team league. Seventh-ranked Texas goes to TCU, which is 8-3 against the Longhorns in Big 12 games.

An Arizona Superior Court judge has dismissed a high-profile child sexual abuse lawsuit against The Church of Jesus Christ of Latter-day Saints, ruling that church officials who knew that a church member was sexually abusing his daughter had no duty to report the abuse to police or social service agencies because the information was received during a spiritual confession. In a ruling on Friday, Cochise County Superior Court Judge Timothy Dickerson said the state’s clergy-penitent privilege excused two bishops and several other officials with the church, widely known as the Mormon church, from the state’s child sex abuse mandatory reporting law because Paul Adams initially disclosed that he was sexually abusing his daughter during a confession to his bishop.

A judge says a federal lawsuit over conditions at a southern West Virginia jail has been settled. U.S. District Judge Frank Volk announced the resolution Tuesday, a week after a federal magistrate judge said some records in the suit had been intentionally destroyed. The lawsuit was filed last year on behalf of current and former inmates about conditions at the Southern Regional Jail in Beaver. The suit referenced a lack of access to water and food, as well as overcrowding and fights that were allowed to continue until someone was injured. The judge says the parties believe a limited class-action settlement fund must be formulated.

Oklahoma State coach Mike Gundy and West Virginia coach Neal Brown have leaped from the hot seat to Big 12 Coach of the Year contenders. Gundy was under scrutiny after the Cowboys lost back-to-back games to South Alabama and Iowa State in September. The team has won five straight, including a 27-24 victory over rival Oklahoma that left the Cowboys tied with Texas atop the Big 12. Brown's West Virginia squad was picked last in the 14-team league. The Mountaineers already are bowl eligible and are one game out of the league lead. They visit No. 17 Oklahoma this week.

Quinn Slazinski scored 18 points, Jesse Edwards had 13 points and 13 rebounds, and West Virginia beat Missouri State 67-59.  It took a while, but the Mountaineers were able to put a tumultuous offseason behind after the resignation of coach Bob Huggins following a drunken driving arrest. West Virginia made only four first half-field goals, then went ahead by as many as 11 points after halftime. Chance Moore led Missouri State with 24 points. He hit a 3-pointer with 41 seconds left to trim the deficit to 61-59. But the Bears didn’t score again. West Virginia’s Seth Wilson scored all 11 of his points after halftime.

Local governments in West Virginia will start seeing opioid settlement money by the year’s end. Jefferson County Prosecuting Attorney Matt Harvey says around $73.5 million will be deployed to municipalities and counties this calendar year in the state most hard-hit by the opioid epidemic. Harvey was elected chair of the West Virginia First Foundation at the board’s first meeting on Monday. Local governments will have the final say on how they want to spend the funds. The nonprofit foundation is receiving $217.5 million as part of its first allocation this year and its board of representatives from regions across the state will decide how it’s spent.

Officials have declared a state of emergency in a western North Carolina community where a wildfire has burned hundreds of acres, some structures and now is threatening dozens of homes. Crews are fighting several separate blazes in forested areas of Virginia, Tennessee and Kentucky as wide swaths across those states face moderate to severe drought conditions and warmer than normal temperatures. Officials in Henderson County, North Carolina, declared a state of emergency Sunday and said in a social media post that the 431-acre fire has destroyed two homes, a cabin and an outbuilding. Officials have identified 75 other structures that are threatened. Officials warned of hazardous fire conditions and urged people not to burn.

Undrafted rookie quarterback Tyson Bagent and the Chicago Bears had their way with one of the top-rated defenses in the NFL for nearly three quarters. But they couldn’t cross the 50-yard-line in the fourth quarter. Bagent threw two interceptions and lost a fumble on a sack in the fourth quarter. He blamed himself for the Bears’ 24-17 loss to the New Orleans Saints. Chicago never got past its own 35-yard line in five series after tying the score at 17 late in the third quarter. Bagent was 18 of 30 for 220 yards with two touchdowns in this third start for injured starter Justin Fields. Bagent likely returns to the bench with Fields having returned to practice Friday.

West Virginia becomes bowl eligible with a 37-7 victory over BYU. Freshman Jahiem White rushed for a season-high 146 yards while CJ Donaldson ran for 102 yards and two short touchdowns for the Mountaineers. West Virginia amassed 336 yards on the ground. That's the most under fifth-year coach Neal Brown. West Virginia jumped ahead 27-0 at halftime and cruised from there. Junior college transfer Jake Retzlaff made his debut for BYU in place of the banged up Kedon Slovis. The Cougars failed to reach 300 yards of offense for the fifth straight game. They lost their fourth straight road game in Big 12 play.

Joey Aguilar threw three touchdown passes and Appalachian State rode a 21-point second quarter to a 31-9 victory over Marshall. After a scoreless first quarter, the Mountaineers got two touchdown passes from Aguilar and a TD run from Milan Tucker to take a 21-3 lead at halftime. Aguilar added a 29-yard touchdown pass to Makai Jackson in the third quarter and Michael Hughes kicked a 31-yard field goal in the fourth. Aguilar completed 19 of 26 passes for 226 yards and spread his completions among 10 receivers.

Two West Virginia corrections officers have pleaded guilty to a federal charge stemming from the fatal beating of an inmate. Southern Regional Jail officers Andrew Fleshman and Steven Wimmer entered the pleas to a conspiracy charge Thursday. They face up to 10 years in prison. The officers were accused of conspiring to deny Quantez Burks’ right to due process. Court records show Burks was assaulted twice after he tried to leave his housing unit. He died less than a day after he was booked into the jail on a wanton endangerment charge. The case has brought scrutiny to conditions and the number of deaths at the jail.

A business group that advocates for clean energy estimates that 403,000 jobs will be created by the 210 major energy projects announced since the Inflation Reduction Act took effect in mid-2022. At least $86 billion in investments have been announced, with the biggest likely job gains in electric vehicles, battery storage and solar energy. E2 executive director Bob Keefe called it “the biggest economic revolution we’ve seen in generations.”

A key figure in West Virginia University’s wide-ranging reductions to academic programs and faculty positions is stepping down. Rob Alsop has been the university's vice president for strategic initiatives since 2017. University President E. Gordon Gee says Alsop will become his special adviser for the next three months before leaving for good. A statement from the university did not specify whether Alsop had found a new job elsewhere. Alsop had an upfront role in explaining proposals and initiatives during key university meetings. In September the university’s Board of Governors approved the academic and faculty cuts as it grapples with a $45 million budget shortfall.

West Virginia guard Kerr Kriisa has been suspended nine games for receiving impermissible benefits. West Virginia announced the suspension Tuesday. West Virginia’s athletic department says it learned in late August that Kriisa admitted to receiving the benefits while enrolled at Arizona. Kriisa arrived at West Virginia in April with two years of eligibility remaining after three seasons with the Wildcats. West Virginia says it worked with the NCAA to reach an appropriate resolution. Kriisa can continue to practice and travel with the team during his suspension. Kriisa averaged nearly 10 points and led the Pac-12 in assists with five per game last season.

A federal magistrate judge has recommended a default judgment in a civil rights lawsuit over conditions at a West Virginia jail. U.S. Magistrate Judge Omar Alboulhosn cited the intentional destruction of records in asking a U.S. district judge to find for the plaintiffs in the class-action lawsuit. The magistrate judge says he believes the failure to preserve the evidence that was destroyed was not simply an oversight. The suit was filed last year on behalf of current and former inmates at the Southern Regional Jail in Beaver. The inmates described conditions at the facility as inhumane.

Republican Gov. Jim Justice has appointed a city administrative clerk from central West Virginia to the state Legislature. Erica J. Moore, a Roane County Republican who works as a city of Spencer utility clerk, will represent the 15th district in the state House of Delegates. Moore will serve the remainder of the term vacated by former Del. Riley Keaton. Keaton announced earlier this month that he was departing to take a state government job. Moore said she’s looking forward to serving in the Legislature and contributing to policy with her knowledge of water and sewer issues from her work with the city.

American gymnastics legend Mary Lou Retton says she is “overwhelmed with all the love and support” she has received and is slowly recovering with family after being hospitalized with a rare form of pneumonia earlier this month. The 55-year-old Retton posted a statement Monday on Instagram in her first public comment since being in intensive care in a Texas hospital. Retton said she was “beyond blessed for the opportunity to make this statement” and is staying positive through what she knows is a long and slow recovery process.

West Virginia forward Akok Akok has been released from a hospital where he was taken after collapsing on the court during an exhibition game. West Virginia interim coach Josh Eilert says Akok is recovering at his home and will be monitored by the school's medical team. Akok suffered what the athletic department called a medical emergency of Friday night's charity exhibition game with George Mason. Medical personnel attended to Akok for several minutes before he was removed on a stretcher. Akok transferred to West Virginia after playing last season at Georgetown. He also spent three seasons at UConn.

Jarrett Guest passed for 289 yards and three touchdowns, Jared Brown had five receptions for 117 yards and two TDs, and Coastal Carolina beat Marshall 34-6. The Coastal Carolina defense forced five turnovers, including four interceptions. Kade Hensley kicked a 36-yard field goal to open the scoring and, after Guest threw a 30-yard touchdown pass to Brown, added a 33-yarder that made it 13-0 with 12:40 left in the first half. Rece Verhoff kicked field goals of 23 and 44 yards for Marshall.

Garrett Green ran for three touchdowns, West Virginia’s defense forced four turnovers, including two interceptions from cornerback Beanie Bishop Jr., to slow down the high-powered UCF offense and the Mountaineers beat the Knights 41-28. UCF quarterback John Rhys Plumlee threw three interceptions and fumbled after a sack to allow West Virginia to pull away in the fourth quarter for the win. Plumlee threw for three scores and ran for another.

West Virginia forward Akok Akok has been hospitalized after collapsing on the court during a charity exhibition game. West Virginia's athletic department says Akok suffered a medical emergency early in the second half of the game with George Mason. Medical personnel attended to Akok for several minutes before he was removed on a stretcher. A school statement says he was taken to a hospital for further observation. The game eventually resumed. Akok transferred to West Virginia after playing last season at Georgetown. He also spent three seasons at UConn.

A West Virginia school district has passed a policy mandating annual religious freedom training as part of a lawsuit settlement. The settlement was finalized Thursday. It comes after some students were required to attend an evangelical preacher's religious revival assembly during the school day in 2022.  Cabell Board of Education lawyer Brian D. Morrison said in a statement that the policy makes clear that it is “not the province of a public school to either inhibit, or advance, religious beliefs or practices.". The policy also requires the district superintendent and principals “to attempt in good faith” to monitor school-sponsored activities to ensure policy compliance.

A West Virginia public school teacher has been appointed to an open seat in the state House of Delegates. Republican Jeffrey R. Stephens was appointed by GOP Gov. Jim Justice on Thursday to represent the House’s 6th District, which serves Marshall County in the state’s Northern Panhandle. Stephens replaces Charlie Reynolds, who resigned earlier this month to take a position at the West Virginia Division of Highways. There is a little bit over a year left of Reynolds' term. Stephens teaches West Virginia Studies and is the athletic director at Sherrard Middle School within the Marshall County school system. He previously coached football and girls’ basketball in the district.

Huntington Mayor Steve Williams says he has filed paperwork to raise money to run for West Virginia governor in the wide open Democratic race. Williams said in a statement that he filed his pre-candidacy papers Thursday. He announced his intention to run last month during the United Mine Workers of America 84th Annual Labor Day Celebration in Racine. Seven Republicans have filed pre-candidacy papers, and Attorney General Patrick Morrisey has announced he’ll seek the governor’s office. Filing pre-candidacy papers allows campaigns to start fundraising. Republican Gov. Jim Justice is prohibited by law from seeking a third consecutive term.

Houston coach Kelvin Sampson knows that the Big 12 is full of what he called German shepherds. In other words, the former Oklahoma coach is bringing his current program from the American Athletic Conference to what historically has been the toughest league in the country. UCF and Cincinnati also are joining from the American while BYU is coming over from the West Coast Conference. All of them could be in for some growing pains as they take a dramatic step up in competition this season.

West Virginia had an offseason that no one hoped for. Hall of Fame coach Bob Huggins is gone following a June drunken-driving arrest. Assistant Josh Eilert was named interim coach and worked to keep his roster from imploding. Several players left, many newcomers were added and only four veterans return. Five players on the roster were born overseas. The Mountaineers will rely heavily on a pair of transfers: center Jesse Edwards from Syracuse and Kerr Kriisa from Arizona. West Virginia opens the season at home Nov. 6 against Missouri State and starts Big 12 play Jan. 6 at seventh-ranked Houston.

A West Virginia prosecutor says a man has been charged with murder in connection with the disappearance of a 10-year-old girl more than two decades ago. Raleigh County Prosecuting Attorney Ben Hatfield told news outlets a special grand jury handed down an indictment Tuesday charging Larry Webb with killing Natasha “Alex” Carter. The girl and her mother, Susan Carter, haven't been seen since Aug. 8, 2000. The FBI announced a renewed push for answers in the case in 2021 and police executed search warrants at Webb’s home in 2022 and 2023, saying additional evidence was recovered. During the last search, Webb told news outlets he didn’t know what happened to the girl.

American gymnastics icon Mary Lou Retton has returned home following a lengthy hospital stay because of pneumonia. The oldest of Retton’s four daughters posted Monday on Instagram that her mother is in “recovery mode.” Shaley Kelley Schrepfer said the 55-year-old Retton faces a “long road” but that she is taking “baby steps.” The update comes nearly two weeks after Retton's family said the 1984 Olympic all-around champion was “fighting for her life” in intensive care.

Rookie quarterback Tyson Bagent likely will start his second straight game when the Chicago Bears visit the Los Angeles Chargers this week. Coach Matt Eberflus says Bagent is in line to be behind center again with Fields doubtful to play because of a dislocated right thumb. Bagent delivered a steady performance in a 30-12 victory over Las Vegas on Sunday. Undrafted after a record-setting career at Division II Shepherd University in West Virginia, he led three touchdown drives in his first start, and the Bears won for the second time in three games after losing 14 in a row.

Coastal Carolina coach Tim Beck said starting quarterback Grayson McCall is doubtful for this week's game against Marshall after sustaining a scary hit that sent him to the hospital at Arkansas State this past Saturday. McCall was sliding to finish a run when he took a hit and it appeared his head bounced off the turf. McCall spent several moments lying on the ground before he was carted off and spent the night at a medical facility for observation. Beck said McCall did not suffer a concussion and is home and in good spirits.

Ollie Gordon II rushed for a career-high 282 yards and scored four touchdowns to lead Oklahoma State to a 48-34 victory over West Virginia. Alan Bowman threw two scoring passes for the Cowboys. Oklahoma State earned its third straight win and moved into a second-place logjam in the league. Gordon now has four straight 100-yard rushing performances. He surpassed his previous single-game high of 168 yards set a week ago in a 39-32 win over Kansas.  Gordon put the game on ice with scoring runs of 46 and 53 yards in the final four minutes. West Virginia has lost two straight.

There is a rematch this week of last year's Big 12 championship game when TCU plays at Kansas State. The Wildcats won that title game in overtime last December after TCU had an undefeated regular season. Both teams go into Saturday's game coming off bounce-back wins last week. Also in the league this weekend, Oklahoma senior quarterback Dillon Gabriel faces his former team when the sixth-ranked and undefeated Sooners host league newcomer UCF. Gabriel is third nationally with 347 total yards per game. He threw 70 touchdowns in 26 games for UCF from 2019-21 before transferring to Oklahoma.
